"The former Law relative to debts was directed against 'persons who remained with, went into, or were sent within the Enemies lines.' Mr. Clarke was not within either of these descriptions not having remained with, gone into, or been sent as therein mentioned. This Law is declared to operate only where persons then (at the time of passing the law in 1782) without the lines were indebted to persons then within the lines. Mr. Clarke being then decsd could never be deemed subject to this Law . . . "
