a rare survival of an act that never came to be. In a series of cases known as the Civil Rights Cases, the Supreme Court held that the Civil Rights Act of 1875 was not constitutional under the Thirteenth and Fourteenth Amendments. The Court then established the state-action doctrine, thereby allowing segregation and discrimination by private actors. This seriously affected civil rights across the nation until the civil rights struggle of the 1950's and 1960's. In an attempt to counter the Court's decision, Congressman John Hill (1821-1884) of New Jersey placed this act on the table. It essentially guaranteed equal treatment under the law for all. It was not passed.
